Asteliar is a platform dedicated to memory, to places, to experiences, and to the people who lived them.
The platform exists to foster encounters between real people and the sharing of experiences located in space and time.
For this reason, Asteliar requires users to present themselves with their real first and last name.
To use the features reserved for registered users, it is necessary to:
The declaration of being at least 18 years old must be truthful.
A false declaration constitutes a violation of these Terms and results in the deletion of the account, without prejudice to any retention Asteliar may be required or entitled to carry out under the law.
Users must use their own first and last name, and may not:
Asteliar is not designed as an anonymity-based platform.
Users may publish Memories by associating them with a place and a period of time.
A Memory must be used to recount an experience, a moment, a place, or a situation genuinely connected to the author's own experience.
Asteliar does not carry out a prior verification of the truthfulness of memories. The author nonetheless remains responsible for the information they publish.
Bottles are messages associated with a specific place and period of time.
Their particular way of being displayed must not be interpreted as a guarantee of secrecy.
Users must not use a Bottle to publish data they intend to keep private, or information they have no right to disclose.
Information relating to places and events must be entered in good faith and, as far as possible, kept accurate and up to date.
Anyone requesting ownership or management of a place must be able to demonstrate, when asked, a legitimate connection with the business or place in question. Verification takes place through a phone call from Asteliar staff to the number provided in the request: whoever requests ownership must therefore be reachable at that number.
It is not permitted to appropriate the identity or commercial presence of someone else's business.
Information that a confirmed owner chooses to add to their own place (phone number, website, opening hours, description) relates exclusively to that place and does not constitute invasive advertising or irrelevant promotional content under point 9.
Terminology note: the "ownership" of a place described in this section is a role internal to the platform, distinct and unrelated to the "Data Controller" defined in the privacy notice.
Authors may edit their own content through the functions made available.
The ability to edit content does not allow a removal or moderation sanction to be circumvented.
Content removed from the platform for violating these Terms may not be reused through edits or republication intended to work around that decision.
Users may upload images within the technical limits provided by the platform.
Whoever uploads an image declares that they have the right to publish it, or otherwise a legitimate basis for doing so.
Images must not be published that:
The automatic removal of EXIF metadata does not transfer to Asteliar responsibility for the publication of the image.
When only one or some of the images of a piece of content violate these Terms, Asteliar may remove the individual images concerned without necessarily removing the entire content they belong to.
The following are not permitted:
Users must pay particular attention when recounting experiences that involve other people.
Unnecessary personal data, health information, information relating to the private life, or other particularly sensitive information about third parties must not be published when there is no valid reason to disclose it.
The fact that the author personally knows a piece of information does not mean the author automatically has the right to publish it.
Users must hold the necessary rights to publish text, photographs, and other material uploaded to the platform.
It is not permitted to upload material copied from others when doing so would violate the relevant rights.
Users may report content they consider contrary to these Terms.
Reports must be made in good faith and must not be used to harass other users or to attempt to remove content simply because it is not shared.
Asteliar may examine reported content and adopt the measures provided for by these Terms.
Content may be temporarily hidden or removed when it:
The system may automatically apply certain protective measures, which may be followed by staff review.
Depending on the severity and nature of the violation, Asteliar may:
These measures may also be adopted when necessary to protect other users or the security of the platform.
Asteliar may retain the technical information necessary to document fraudulent conduct, abuse, or unlawful activity even after account deletion, within the limits allowed by applicable law.
Users may delete their own account through the function provided by the platform.
Deletion results in the removal of the account and the content associated with it.
Account deletion does not entitle the user to request the deletion of records that Asteliar is entitled or required to retain for security purposes, abuse prevention, the investigation of unlawful conduct, or legal obligations.
Asteliar is built on personal memory and on the possibility of finding people, places, and experiences from the past again.
This calls for particular respect toward the people involved in the stories being told.
Before publishing content, users should ask themselves:
Is it necessary to publish this information? Do I have the right to do so? Could it unjustly harm someone?
Use of the features reserved for registered users implies acceptance of these Terms of Use.
These Terms may be updated when necessary. The version in force will be made available on the platform.
